Appeal Process
The
Outstanding Teacher bonus is not part of a teacher's regular salary;
therefore, the potential for being granted the bonus does not
constitute a property right.
- In the event a teacher disagrees
with the determination made by the building administrator, the
teacher may appeal the decision to the Outstanding Teacher
Review Board.
- Any appeal must be filed in
writing and received by the D.C.F.T. office by the 15th of June.
The appeal must include copies of both sides of the portfolio
feedback sheet, the portfolio and a brief letter of rationale
for the appeal.
- The Outstanding Teacher Review
Board consists of 4 administrators appointed by the district and
5 teachers appointed by the D.C.F.T. president. (The
chairmanship of the Review Board is rotated annually between a
D.C.F.T. member designated by the D.C.F.T. as chair and an
administrative member designated by the district as chair.)
- Prior to filing a written appeal a
teacher must first meet with the building administrator to
discuss the decision during an informal appeal meeting.
- The Review Board will first
conduct a paper review of the portfolio and the portfolio
assessment data.
- The Review Board may request more
information or a personal conference with either the teacher or
the administrator or both.
- Any teacher or administrative
member of the Review Board may choose to withdraw from voting on
an appeal filed by a teacher in his/her building. If one or more
members of either party withdraw from voting or are unable to
attend, an equal number of the other party will withdraw from
voting.
- If the Review Board determines by
a majority plus one of the members voting that the teacher
should in fact be deemed outstanding consistent with the stated
outstanding teacher evaluation criteria, that recommendation
will be forwarded to the Superintendent for final review and
action. If less than the required number of members support a
finding that the teacher is outstanding, the teacher's appeal
will be deemed denied and forwarded to the Superintendent.
- The Superintendent will make the
final decision that will be binding upon all parties.
- Neither the recommendation of the
Review Board nor the decision of the Superintendent is subject
to further appeal through the grievance procedure.
- All appeals will be heard and
decided by the Superintendent by July 15.
